X- Milwaukee Road 36A is now out of the paint shop with out lettering in as built gray red and YELLOW! I wonder how many UP people will drive by and think " when did we send a "E" to CEECO and why"mg:

I've heard this told. Again, I'd love to see them try pursuing it. There have been, and are so many artistic variations to the portrayal of our flag. I'm sure a few have been very close to their style, and preceeded the borg-art. Wouldn't it be lovely to have this backfire in their faces? What an excellent potential PR boondoggle! yeah, I don't know how they can copyright "our" flag, but they did. I saw a link on another site about it. The link showed every RR herald they own, plus the American flag that they are now putting on there crappy locomotives. And just my two cents about there so called "heritage" paint schemes for all the railroads they put out of business. As a big time SP fan, I find that painting a borg locomotive in my railroads colors, putting the year they took them over (1996), and putting "building America" on it, plus BS about the preservation, is a big insult. How can you be "building America", when your putting people out of jobs, and monopolizing most of the railroad world. Heritage and preservation, my butt. Thom
New to the group and on a slightly different thread. I have an HO Proto 2000 E7 Milwaukee in yellow, red, and grey. I also have a heavyweight passenger set in orange and black. I am thinking of repainting the whole shebang to the 1948 Columbian color scheme for a matched set. How much of a heretic am I going to be? The pictures of the E9 are beautiful. I have the Proto 2000 model of that one as well.

In all fairness the Union Pacific RR isn't claiming ownership of the American Flag. They are claiming ownership of a depiction of the flag used on their locomotives. This flag is much different than what is depicted ubiquitously in society and the US government. The only one similar as I recall is Burlington Northern's used on their "Whiteface" scheme. http://www.uprr.com/aboutup/licensing/index.shtml
A few comments. Were their any clauses in the passenger rail agreement between UP and Mil that would have specified the trademarked nature of the paintscheme? Obviously, you can't trademark colors, but UP certainly could trademark the scheme. Ome other thing. a couple pages back, under the definition of the borg. I didn't think it was just that they gobbled up every railroad in the west. BNSF have certainly done their share of gobbling. What makes them the borg is that they assimilate others and maintain their corporate image. If BN and ATSF had merged and the resulting Railroad had been called Santa Fe and all the locomotives immediatly painted in some version of a Warbonnet, that would be the UP. Of course, there are those that may think that better.. UP has subsumed the identities of every railroad it has previously purchased. It leaves nothing behind if it can help it (SP was a little too big and caused some indegestion. They deserved it.). Which is what makes them the borg, but also what makes these Heritage locos a crock of @#$%.
As far as harbor gray and armor yellow on Milw locomotives even after the start of Amtrak and METRA? Milw did not change some of the units to orange and black,the FP45 where changed,so I don't belive UP could have a fit since the 36A will have Milw logos and THE MILWAUKEE ROAD lettered on the sides.
