I agree it is not too much. These days, if you hit someone over the head with a baseball bat, it still would not get their attention. Duh. It might not be aimed toward just for the party wishing to cross those tracks, but to protect themselves from that inattentive party suing them, after the inattentive party gets hit by a train.
