Dont know if you guys are aware of not, but under US trademark law if someone owns a trademark and does not actively defend and enforce that trademark they can lose it.
Welcome, CXSBaltimore. Yes, I am aware of it, but there are other ways to enforce it. If revenues were not the goal, UP could have licensed the use of the logo to each model train manufacturer for a dollar per year in return for an acknowledgement that the trademark is still the property of UP.
hmm..... all of my locomotives are getting patch jobs.... furx, hlcx, etc. somtime soon, so will all of the covered hoppers, boxcars, etc..... if anyone asks where's the eeewww-pee.... well i will tell them about the royalty thing, in a civil tone of course!!
Thanx for the welcome. I was under the impression that there was also some level of due dilligence that was expected in the defense of a trademark. I was thinking that a scenario such as what you suggested would not be a vigerous enough attempt. I do concede though that I could be quite wrong. -- John
