    I don't know where to start. Sitting here shaking my head. Seems you can always find someone out there that thinks they have the right to tell someone else, what they can and can't do. Looney tunes out there wanting to harass whomever they can.

    Some of the post-article comments are so lame. The layout is neither an "improvement", nor "alteration" of the property. No more than having a dining table and chairs, or a bedroom set.

    These days, many people are declining to form a homeowners association, because of these ridiculous horror stories. Both my current neighborhood and the one previous, we residents overwhelmingly voted to not have an HOA. Just because of such known incidents in this country. There are already too many, (city, county, state, national), regulations which must see compliance. We are not going to further tighten the noose already around our necks.

    In Britain they tend to go a bit nuts with "regulations". There just has to be one person complaining and they don't ask questions or take reason into account. The book gets thrown and that's that. The crazy cat lady across the hall complains, she's right and you're wrong, regardless of the four dozen cats stinking up the joint.

    I do believe that he rents not owns ...

    If I was the landlord, I would ask him to remove it so that I could make the appropriate repairs and inspections or have him sign documents that would release my workers and myself for liability for damage to the layout while the work was being done.
    And I would certainly allow him to put it back up after the work was completed.

    I cant stand HOA rules and regs. Yes I have a HOA at my neighborhood, but it is very laxed. There are people I know in my town that have strict HOA rules. For example one guy I know he cant park ANY cars in the driveway................period under ANY circumstance. He was actually fined one Thanksgiving Day by his HOA president $150 per car. I visited my sister one time in Denver and we had to park the rental car about a mile away at Walgreens because their HOA stated the same thing. Long story short, it was NOT fun. With that being said, I feel that if I am paying the mortage on the damn place I should be able to do what the he!! I want, including painting it purple with pink polka dots.

    Unfortunately I can well and truly believe that he will be made to take it down or send some goons to "take it down" for him, councils over here do not see reason for anything once that they have made their mind up on something...

    The removed timber that they had to replace is odd, since the resident claims he did no such thing.
    There was the guy in Oregon who built a big ride-on outdoor railway.
    No problem until word got around and all sorts of folks showed up on weekends to ride it.
    The gummint will find a way to thread you.
    Seems he built small bridges across creeks, and it was some environmental deal on salmon runs, I think.
    When we got annexed into the city, I had to find an attorney to tell me my outdoor railroad was grandfathered in, since it was built during County oversight and they had no rules to govern it.
    I do recall some sports star who brought in loads of dirt to level his yard, and got nailed for geologic reasons, something about loading a hillside.
    Since all my dirt came from my property, just re-distributed, I'm safe.

    I feel badly for him, but the agency is within their rights to have a clear and free access to correct faults. It is always a hazard of renting vice owning...they have all those regs to keep tenants knuckled under. If he is creative, he can remove it without too much bother, and then apply formally to restore it once the repairs are done. If he can demonstrate that it is essentially modularized and removable within six or seven hours, I can't see why they wouldn't relent.

    Back when I was in college, I rented an apartment, like many us did at that time in our lives. Well one day I got a notice saying that they needed access into my apartment to do the annual fire place chimney cleaning. No big deal right? A couple days after that I get another notice that the apartment mgr wanted to see me in the office at my earliest convenience. Turns out when they were doing the inspection/cleaning they noticed my paints and glues on my work desk. The apartment mgr told me that the contents were hazardous and was a violation under my rental agreement. So I had to quit modeling for a couple years. It sucked, trust me. But it sure beat being thrown out on the streets. Now that I am a home owner, someone will have to come in and bulldoze the place over before I take the trains out.

    As Eddie Murphy said, "Its my house, and if you dont like it, get the eff out."

    Man, am I glad that my neighbors and neighborhood assn. members approve of my layout in the back yard. I have 2 layouts in the house also...even the city code inspectors drop by from time to time to see what's new on the layout. Maybe it helps that I live in an "eclectic" neighborhood with cool folks around. I'm afraid that if I were that poor dude in the attic, I would be answering the door with two barrels of 00 buckshot!

    The article doesn't really go into enough detail for me. But it's sad to see a guy have to tear out his railway. Then again, It's always a chance to build better.

    Until we bought the home we have now, every layout I ever had was modular or sectional. Even the N scale layout I had before the latest HO scale effort was on a hollow-core door. Nowadays, I'm glad to be in a home where I can put a nail in any darn wall any darn time I please.

    Why anyone would move into a neighborhood with an HOA, or be instrumental in starting one, stumps me.

    My attitude on HOA's is less than Politically Correct, so lets just say I see them to be lame. My ex and I bought a house in a vinyl village that had a HOA and before long we butted heads. My ex wanted a G scale train in the back yard, nope, not allowed. No little pond either. I could not have a trailer for my planes. I'm not talking a dilapidated wooden trailer but a nice white Haulmark brand trailer. No front porch swings either. I was warned a few times about my loud "Head Banger" music playing from my Jeep, yet the loud Rap music with bass that shook the windows was tolerated. The final straw was the memo saying "no flags" after the 4th of July. Funny the flags of other nations were allowed to stay up, so I hoisted a Union Jack, never got a complaint....

    Worthless 1% wanna be's regs for people who think they don't need a fan in their bathroom.

    Go figure,, the Brits ...who have thunk it. Maybe if the same zeal was applied to eastern Europe after ww2 there would have never been the communist block.

    People are too quick to seek legal action,,or other extreme actions.
