Designs stolen from thingiverse.com put on Cults3D....

    Any of you post your designs on thingiverse.com?

    I found out yesterday that 111 of 138 designs I have on thingiverse.com are now on cults34.com. I have an account there but never put up any designs. The ones that are up are under my name but not under the account I have there. I can access them like anyone can but not as the person who added them to the site. You can find them by searching 'sumner' on both sites.

    There is a picture of what is suppose to be me I guess as a young guy drinking beer. At 79 it for sure isn't me. The files you can download are the same and the design descriptions are the same word for word as to what I have on thingiverse. I can't see where this is benefiting anyone but possible driving people to cults to download files and they make money on the adds there. I see a lot of downloads for my designs there so people are using the site a lot.

    I put the girder bridge i posted here a few days ago up on thingiverse about the same time. Then two days later added the files for the abutments. I see that is also already on Cults but missing the added files. Be interesting to see if they show up in the next day or so.

    I have a message to Cults about this. I'll post back if they respond or not. I've had other items from my personal site dealing with cars and boats posted different places on the Internet and other people taking credit for them. The good and the bad of the Internet :):(.

    My guess is either they are trying to get as many files on their site as the can or that someone is trying to make your files more accessible (and take some of the credit). One one hand, this sucks that you did the work only to have it taken from you, on the other , it is letting more people see the work that you have done and allowing them to get use from it.

    I was involved with a website about another hobby I have where we were documenting the start and rise of that hobby only to have some youtuber just take the work we were doing, made youtube videos using even the photos we supplied and just reading the articles we wrote but passing the info off as 'his' original work. We asked him to just give credit to our website, but he wouldn't, especially since he was receiving payment (from youtube) and free stuff from others. In the end, we took the website down since we weren't even being given writing credit for him vids. Another good source of information killed because of anothers stupid actions. I'm hoping this isn't what is happening to your designs.

    I just looked at one of your posts on Thingiverse (https://www.thingiverse.com/thing:4591907, let me know if I got it wrong), and the license posted with it is the Creative Commons - Attribution license, https://creativecommons.org/licenses/by/4.0/. Essentially, if the user provides attribution to you, they can share and adapt this specific work.

    Makerbot has terms for use here: https://www.makerbot.com/legal/terms/. Essentially, you grant two permissions: 1) to Makerbot the permission to use your work, and 2) to others based on a secondary license selection. That's where you selected CC-BY-4.0.

    I use the same license for what I publish, and it's with the realization that others might appropriate it thusly. it sometimes feels wonky, but I do it to put things out there for people to use, and I just accept the implications...

    The user on cults is stated to be me not someone else posting and crediting me. So it looks to anyone that goes there that I posted the items. There is a picture of someone else, who knows where it came from.

    There is a contact button but I used it and it doesn't come to me and so far there has been no response back to me. So someone could use it and get someone else possibly that isn't me. I have no problem with others posting links and such to my work but yes they should at least credit where the work came from.

    Also I haven't heard anything from the Cults staff.

    I wouldn't expect you to hear from anyone at Cults - that's probably their business model to aggregate other people's content and become a single point of contact for freely available 3D files then generate revenue with clicks. Could be fun to contact Cult "Sumner" and ask him if he's ever considered doing tunnel portals or something and see what kind of response you get. If any.

    Yeah, posing as the original content author is not the same as giving credit. Not sure how to approach this one, though, pseudonyms on social media aren't exactly copyright fodder...

    It's a lot of work, but I'd go on every design that they "stole" and report a copyright on it and provide the thingiverse link for the design. You could also submit a DMCA takedown notice to them for that "creator" which they must respond to.

    The file is licensed under creative commons attribution license. This means you can print and modify the file but you need to cite the original creator, by providing their Thingiverse username and a link to their original file, when you display or use the object or a photo or video of it.

    Two questions though. One, would Thingiverse have to pursue this? The other is that so far cults hasn't responded to me and to contact them you use a form on their site so I don't have a direct email to use. I did send a second message citing the above. We will see............

    That's a bummer. I don't design my own 3D prints, but in another build-it-yourself hobby of mine (Lego), people are cagey about publicly uploading instruction/build files of custom models for the same reason. It's shocking how quickly the unscrupulous blankity-blank blanks will copy the file and slap their own name on it.

    Without copyright there's not much you can do except spread the word about the copycats.

    are all the designs there on cult [from that user] originally done by you ?? or did he 'borrow' from somewhere else / or even made his own ??

    OK not sure but maybe there isn't a problem. I set up a Cults3D account 2-3 years ago but never used it. Now looking at that account there is a box on a separate page of setting up an account that if the email you use for thingiverse is in a box they sync everything you put up on thingiverse to Cults. I don't remember ever doing that but maybe during the signup stage I did?

    I'll do some more investigating tomorrow,

    I got an email from Pierre at Cults this morning wanting more info so they are going to work on it. It is very confusing at this point. The designs that are up I can see but can't edit or delete which I should be able to and when I go to 'my designs' under my account it says I don't have any. He is in France and I'm in the States so emailing back and forth with the time difference might take a few days to sort this out.

    well cool they contacted you at least. good luck. this kinda stuff spoils it all for lots of us whom want to print these files and or share our own files.
    i for one love and THANK each one of Y'ALL for your time in creating these files and sharing them with the world.
    this kinda behavior can make it to where people will not share there precious files. I like to print a lots of them and also cut them up and make my own parts . Note Ive had my account from thingy verse taken over by i dunno who and all my files are gone the whole page no login no nuttin.
    it sucks cause i cant replace those. i feel y'alls pain and i do hope that most of you would continue to share your great expertise in those creations.
    i do save a few for future builds ect. i think its exciting to see what others can do with 3d printing. there are some pretty good things out there...

    Actually, your work is copyright protected from the moment it is created. From https://www.copyright.gov/help/faq/faq-general.html:
    You really only have to register it if you want to bring a lawsuit. The Creative Commons licenses is the copyright license. If someone uses your work without giving you credit, they are infringing on your copyright. Again, you cannot sue them with out registering it, but oftentimes just informing them of the infringement is enough to get them to comply.

    Technically you could sue them even without registering copyright since it is a violation of the license of the files. It would certainly be harder without the actual copyright though. Copyright on the designs may also not be easily accomplished since they could submit them for copyright and then "own" them if they submit them first. It's a mess.

    Copyright registration isn't required to successfully assert the right in court, but it makes it easier to establish the assertion's pedigree. If your publication dates can be demonstrated and the assertion "Copyright (date) (author) is provided with the publication, your right is established.

    EXACT same thing happened to me with a design I put on thingiverse last year! That it was also model railroad related is suspicious, since I am not finding other people talking about this happening in other topic areas. I wouldn't think this is the doing of cults3d because I think they know this is inadequate attribution? Did you ever get a resolution to this from them?

    Interesting to note, if you click the question mark by the publication date, it says published on thingiverse on the date I published it. So it's possible cults3d thinks this is ok?
